Terms and Conditions for Black Pearl, PV Vacation Rental Home

These Terms and Conditions govern the use of Black Pearl, PV Vacation Rental Home’s website and the rental of the vacation property located at Puerto Viejo de Talamanca, Limón Province, Costa Rica (hereinafter referred to as “the Property”). By using our website and booking the Property, you agree to abide by these Terms and Conditions. Please read these Terms and Conditions carefully before making a reservation.

1. **Booking Confirmation**: Your booking is confirmed upon receipt of the required deposit or full payment, as specified by the booking terms. A confirmation email will be sent to you upon successful booking.

2. **Rental Period**: The rental period begins at 3:00pm on the arrival date specified in your booking and ends at 10:00am on the departure date specified in your booking, unless otherwise agreed upon in writing.

3. **Payment Terms**: Payment terms are outlined during the booking process and may vary depending on the booking platform or method used. Failure to make payment according to the specified terms may result in cancellation of your reservation.

4. **Security Deposit**: A security deposit may be required to cover any damages or additional cleaning fees incurred during your stay. The deposit amount and terms for refund will be outlined in your booking confirmation.

5. **Cancellation Policy**: Our cancellation policy varies depending on the time of cancellation relative to the arrival date. Cancellations 30-60 days before arrival date will receive a 50% refund; There are no refunds if cancellations are made within 30 days of arrival date.

6. **Occupancy**: The maximum occupancy of the Property is 6 guests. Only registered guests are permitted to stay overnight at the Property. Exceeding the maximum occupancy without prior written consent may result in additional charges or termination of the rental agreement.

7. **Check-in and Check-out**: Check-in time is at 3:00pm, and check-out time is at 10:00am. Early check-in or late check-out may be available upon request and subject to availability.

8. **House Rules**: Guests are expected to adhere to all house rules outlined in the welcome package provided at the Property. Failure to comply with these rules may result in eviction without refund.

9. **Pets**: Pets are generally not permitted unless explicitly stated otherwise in the booking terms. Additional charges may apply for guests bringing pets. We will collect a refundable $200 pet damage deposit as an add on to your reservation charge. It will be refunded on the day of check out provided the house is in perfect condition. If you bring a pet, the following rules must be adhered to:
a) No animals on furniture
b) You can’t leave any animals alone on the property at anytime
c) Clean up after bathrooms in the yard

10. **Smoking**: Smoking is strictly prohibited inside the Property. Guests may smoke in designated outdoor areas only. Failure to comply may result in additional cleaning fees.

11. **Amenities and Services**: The Property is equipped with WIFI, Pool, fully appointed kitchen with all major appliances, a Nespresso coffee maker, hot water kettle, blender, rice cooker, and more. Certain amenities or services may be subject to availability or seasonal changes.

12. **Liability**: The property owner and management company shall not be held liable for any accidents, injuries, or losses that occur on the Property. Guests are responsible for their own safety and security during their stay.

13. **Termination of Rental**: The property owner or management company reserves the right to terminate the rental agreement and evict guests in the event of violation of these Terms and Conditions or any other disruptive behavior.

14. **Changes to Terms and Conditions**: The property owner reserves the right to amend these Terms and Conditions at any time. Any changes will be effective immediately upon posting on the website. It is the responsibility of the guest to review these Terms and Conditions periodically for updates.

15. **By making a reservation and staying at the Property, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. If you have any questions or concerns, please contact us prior to booking.
